Terms and Conditions

Please read these Terms and Conditions carefully before using the Blockchain Council website, applications, and services. By accessing or using our platform, you agree to be bound by these terms.

1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Blockchain Council website, applications, digital products, certification programs, and all related services (collectively, the "Platform"). Blockchain Council ("BCC") is a wholly-owned brand under the ownership and operational control of Tosh Innovations Private Limited, a company incorporated under the laws of India.

By accessing, browsing, registering on, or otherwise using the Platform, you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional guidelines, policies, or rules posted on the Platform.

Important: If you do not agree to these Terms in full, you must not register for, access, or use the Platform. Your continued use of the Platform after any amendments constitutes acceptance of the revised Terms.

These Terms take effect on the date you first access or use the Platform and remain in effect until terminated in accordance with the provisions herein. Blockchain Council reserves the right to modify these Terms at any time by posting updated versions on the Platform. It is your responsibility to review these Terms periodically. Material changes will be indicated by updating the "Last Updated" date above.

2. Definitions & Interpretation

In these Terms, unless the context otherwise requires:

  • "BCC," "we," "us," "our"refers to Blockchain Council, a brand owned and operated by Tosh Innovations Private Limited, its subsidiaries, affiliates, and authorized representatives.
  • "User," "you," "your"refers to any individual, entity, or organization that accesses, registers on, or uses the Platform.
  • "Platform"refers to the Blockchain Council website (blockchain-council.org), all associated web applications, mobile applications, APIs, and digital services.
  • "Content"refers to all text, images, graphics, videos, course materials, e-books, infographics, certifications, software, code, and any other material published on or delivered through the Platform.
  • "Certification Products"refers to all online courses, examinations, digital credentials, certificates, and associated learning materials offered by BCC.
  • "Restricted Activities"refers to the prohibited conduct described in Section 14 of these Terms.

References to statutory provisions include any statutory modification or re-enactment thereof. The headings in these Terms are for convenience only and shall not affect their interpretation. Where there is any conflict between these Terms and any rules or specific terms appearing on the Platform relating to specific material, the latter shall prevail.

3. User Obligations

By accessing, using, and/or downloading materials from the Platform, you agree — on your own behalf and on behalf of each entity and person on whose behalf you act — to comply with the following obligations:

  1. You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Platform. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
  2. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  3. You shall not use the Platform for any purpose that is unlawful, fraudulent, or prohibited by these Terms, nor in any manner that could damage, disable, overburden, or impair the Platform.
  4. You acknowledge that BCC may utilize your information, including your name, designation, and profile details, to showcase you as a valued member of the Blockchain Council community on public-facing materials.
  5. You shall not attempt to gain unauthorized access to any part of the Platform, other user accounts, computer systems, or networks connected to the Platform.
  6. You shall ensure that all information you provide to BCC is accurate, current, and complete, and you agree to update such information as necessary.

Failure to comply with these obligations may result in the immediate suspension or termination of your account and access to the Platform, without prior notice or refund.

4. Account Registration & Security

Certain features of the Platform require you to create an account. When registering, you agree to:

  • Provide truthful, accurate, and complete registration information.
  • Maintain and promptly update your registration information to keep it current.
  • Keep your password confidential and not share your account access with any third party.
  • Notify BCC immediately of any unauthorized use of your account or any other security breach.
  • Accept responsibility for all activities that occur under your account, whether or not authorized by you.

BCC reserves the right to suspend or terminate any account that we reasonably believe has been used in violation of these Terms, without prior notice and without liability.

5. Copyright & Intellectual Property

All names, images, logos, trademarks, service marks, trade dress, and visual identities displayed on the Platform — including those identifying BCC, its affiliated companies, or third parties — are proprietary marks of Blockchain Council, its parent entity Tosh Innovations Private Limited, or their respective owners.

All copyright, trademarks, database rights, and other intellectual property rights in the Platform and all Content supplied as part of the Platform's services shall remain at all times the exclusive property of BCC or its licensors. Nothing contained herein shall be construed as conferring — by implication, estoppel, or otherwise — any license or right to use any trademark, patent, or other intellectual property of BCC or any third party.

Trademark Notice

All certification products bearing the ® symbol are registered trademarks in India. Trademark applications are underway in other jurisdictions. The ® symbol indicates Indian registration only; elsewhere, rights are claimed under common law or pending applications. Unauthorized use of BCC trademarks is strictly prohibited and may result in legal action.

By accessing the Platform, you agree that you do so only for your own personal or authorized commercial use. You may not — and may not permit or assist any third party to — copy, reproduce, download, post, store (in any medium), distribute, transmit, broadcast, commercially exploit, create derivative works from, or modify in any way any Content without BCC's prior written permission.

6. Anti-Piracy Policy

BCC takes the protection of its intellectual property extremely seriously. You expressly agree not to pirate, copy, duplicate, record, screen-capture, redistribute, or otherwise reproduce any educational or non-educational Content from the Platform by any means — digital, mechanical, or otherwise.

All Content on the Platform and its associated websites is copyrighted and protected under applicable international intellectual property laws, including but not limited to the Indian Copyright Act (1957), the Digital Millennium Copyright Act (DMCA), and the Berne Convention for the Protection of Literary and Artistic Works.

Violations of this policy may result in immediate account termination, revocation of certifications, and legal proceedings for damages and injunctive relief.

7. Acceptable Use Policy

The Platform shall be used only for lawful purposes and in a manner that does not infringe upon the rights of — or restrict or inhibit the use and enjoyment of the Platform by — any third party. Such restriction or inhibition includes, but is not limited to:

  • Conduct that is defamatory, harassing, threatening, abusive, or discriminatory.
  • Transmission of obscene, offensive, or unlawful content.
  • Activities that interrupt or impair the normal functioning of the Platform.
  • Attempting to probe, scan, or test the vulnerability of any system or network connected to the Platform.
  • Using any automated system (bots, scrapers, crawlers) to access the Platform without BCC's express written consent.
  • Uploading or transmitting viruses, malware, or any other malicious code.
  • Impersonating any person or entity, or falsely representing your affiliation with any person or entity.

8. Certification & Alumni Terms

By enrolling in and/or obtaining any certification from BCC, you acknowledge and agree to the following:

  1. Certifications are granted based on successful completion of prescribed coursework and/or examinations as determined by BCC at its sole discretion.
  2. You grant BCC permission to include your name, designation, company name, profile picture, and testimonial on its official website, social media channels, and promotional materials, recognizing you as an esteemed alumnus of the Blockchain Council.
  3. Certifications are non-transferable and are issued to the individual who completed the program. Any attempt to transfer, sell, or misrepresent a certification is a violation of these Terms.
  4. BCC reserves the right to revoke any certification at any time if the holder is found to have engaged in Restricted Activities, fraud, or any conduct that brings BCC into disrepute.
  5. Certifications do not constitute a professional license, academic degree, or government-recognized credential unless explicitly stated.

9. Third-Party Links & Services

The Platform may contain links to third-party websites, applications, or services that are not owned or controlled by BCC. Blockchain Council:

  • Is not responsible for the availability, content, accuracy, or practices of any third-party websites or materials you access through the Platform.
  • Does not endorse and is not liable for any content, advertising, products, services, or information available on or from third-party websites.
  • Is not responsible for any damage, loss, or offense caused by or in connection with any third-party content, products, or services.
  • Disclaims all liability for any legal or other consequences — including infringement of third-party rights — arising from links made to or from the Platform.

If you decide to access any linked third-party website, you do so entirely at your own risk. It is your responsibility to take all protective measures against viruses, malware, and other destructive elements. Any terms, conditions, warranties, or representations associated with such third-party dealings are solely between you and the relevant provider.

Links to the Platform must be direct links to complete content pages and must not be framed or displayed within the pages of any other application or website without BCC's prior written consent.

10. Software Licensing

From time to time, BCC may make certain applications, tools, or software available for access or download through the Platform. Such software is the protected work of BCC or its suppliers, and you are granted a limited, non-exclusive, non-transferable, revocable license to use the software solely for the purposes for which it is provided.

You may not: (a) use the software for any purpose other than its intended function; (b) redistribute, sell, sublicense, rent, or lease the software; (c) decompile, reverse engineer, disassemble, or attempt to derive the source code of the software; or (d) modify, adapt, or create derivative works based on the software — except to the extent that such restriction is expressly prohibited by applicable law.

11. Payment & Refund Policy

All prices displayed on the Platform are in US Dollars (USD) unless otherwise stated. Prices are subject to change without notice. By completing a purchase, you agree to pay the applicable fees and any taxes associated with your transaction.

Refund Eligibility

BCC offers refunds in accordance with its published Refund Policy. Refund requests must be submitted through the proper channels within the specified timeframe. Digital products that have been accessed or downloaded may not be eligible for a refund. BCC reserves the right to deny refund requests that do not meet the stated criteria.

Chargebacks

Filing a chargeback or payment dispute without first contacting BCC's support team constitutes a violation of these Terms. BCC reserves the right to suspend your account, revoke certifications, and pursue legal remedies in the event of fraudulent chargebacks.

12. Disclaimer & Limitation of Liability

THE PLATFORM AND ALL CONTENT, INFORMATION, NAMES, IMAGES, PICTURES, LOGOS, ICONS, AND MATERIALS RELATING TO BCC AND/OR ANY ASSOCIATED COMPANY, PRODUCTS, AND SERVICES (OR TO THIRD-PARTY PRODUCTS AND SERVICES) ARE PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS WITHOUT ANY REPRESENTATION, ENDORSEMENT, OR WARRANTY OF ANY KIND — WHETHER EXPRESS, IMPLIED, OR STATUTORY — INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, COMPATIBILITY, SECURITY, AND ACCURACY.

BCC does not warrant: (a) the accuracy or completeness of any information on the Platform; (b) that the Platform will be uninterrupted, error-free, or free of viruses or bugs; (c) that defects will be corrected; or (d) the reliability of any statement or information displayed or distributed through the Platform.

You acknowledge that any reliance on any statement, information, or Content on the Platform shall be at your sole risk. BCC reserves the right, at its sole discretion, to correct errors or omissions in any part of the Platform and to make changes to materials, products, programs, services, or prices at any time without notice.

Limitation of Liability

IN NO EVENT SHALL BCC, NOR ITS DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR CONTENT PROVIDERS, BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, OR ANY OTHER LEGAL OR EQUITABLE THEORY WITH RESPECT TO THE PLATFORM FOR:

  1. Any lost profits, data loss, cost of procurement of substitute goods or services, or special, indirect, incidental, punitive, compensatory, or consequential damages of any kind whatsoever (however arising);
  2. Any bugs, viruses, trojan horses, or similar harmful code (regardless of the source of origination);
  3. Any direct damages in excess of, in the aggregate, one hundred US Dollars (USD $100.00).

BCC reserves the right to terminate, change, suspend, or discontinue any aspect of the Platform — including the availability of any features — at any time without notice or liability.

Podcast Disclaimer

The views and opinions expressed by podcast guests are their own and do not reflect the opinions or policies of BCC. Podcast interviews are for informational purposes only. BCC disclaims any responsibility or liability for any content, accuracy, or opinions expressed during podcast episodes.

13. Indemnification

You agree to indemnify, defend, and hold harmless Blockchain Council, Tosh Innovations Private Limited, and their respective officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs — including reasonable attorney's fees — arising out of or relating to:

  • Your use of or access to the Platform in violation of these Terms;
  • Your violation of any applicable law, regulation, or third-party right;
  • Any content or information you provide to the Platform;
  • Any fraudulent, negligent, or wrongful act or omission by you.

BCC is a blockchain education and certification organization and cannot be held responsible for the actions of individuals who have purchased certification courses. If any BCC user engages in illegal activities, victims should contact the appropriate law enforcement agencies. Upon guidance from law enforcement, BCC will take appropriate action including revoking the certifications of individuals found to have engaged in Restricted Activities.

14. Restricted Activities

As a user of BCC, you purchase educational certification courses for self-consumption, for your organization, or for authorized resale. This purchase does not entitle you to misrepresent BCC in any way. You must not engage in the following Restricted Activities:

Represent yourself as a BCC employee, consultant, partner, vendor, or reseller to offer services that BCC does not offer.

Represent yourself as a BCC employee, consultant, partner, vendor, or reseller to offer services that you are not entitled to offer on behalf of BCC.

Claim to be a Bitcoin, cryptocurrency, or blockchain investment expert using counterfeit certifications, fake authority letters, or forged documents purportedly from BCC.

Present yourself as a BCC representative and offer cryptocurrency trading, recovery, investment, or advisory services.

Engage in any fraudulent, deceptive, or illegal activities to defraud individuals or organizations while using your association with BCC as credentials.

Use BCC certifications, logos, or branding to lend credibility to any financial scam, Ponzi scheme, or fraudulent investment operation.

Create fake or misleading profiles, websites, or social media accounts that imply official BCC affiliation or endorsement.

15. Enforcement Actions

If BCC has reasonable grounds to believe that you have engaged in any Restricted Activities or otherwise violated these Terms, we may take one or more of the following actions at our sole discretion, without prior notice:

  1. Issuing a formal written warning to you;
  2. Limiting, restricting, or suspending your access to the Platform and its resources;
  3. Permanently terminating your BCC account without intimation;
  4. Revoking all certificate licenses issued to you, without entitlement to any refund;
  5. Reporting your activities to our partners, affiliated organizations, and any other parties harmed by your conduct;
  6. Lodging formal complaints with the relevant legal authorities, law enforcement agencies, and regulatory bodies in any applicable jurisdiction;
  7. Pursuing civil litigation for damages, injunctive relief, and recovery of legal costs.

16. Cryptocurrency Advisory Notice

Important Cryptocurrency Disclaimer

Blockchain Council does not offer any Bitcoin or cryptocurrency trading, investment, brokerage, or advisory services. We do not offer lost cryptocurrency recovery or wallet recovery services. We do not ask for tax payments on any cryptocurrency withdrawal — whether directly or through any representatives.

Any emails, calls, messages, or social media contacts you receive claiming to offer such services on behalf of BCC are scams. Do not respond to, engage with, or send any funds to such parties. If you encounter suspected fraud involving BCC's name, please report it immediately to hello@blockchain-council.org.

BCC is on a mission to provide education in all blockchain-related fields, including cryptocurrencies. Our cryptocurrency-related courses teach how the industry works, enabling learners to self-study crypto markets and trading strategies. These courses also cover how to safeguard yourself against cyber scams and cybercrimes involving cryptocurrencies. However, BCC does not provide personalized financial advice and none of our Content should be construed as such.

17. Data & Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

BCC implements commercially reasonable technical and organizational measures to protect your personal data. However, no method of transmission over the internet or electronic storage is 100% secure. BCC cannot guarantee absolute security of your data and shall not be liable for unauthorized access resulting from circumstances beyond our reasonable control.

18. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

Any cause of action you may have with respect to your use of the Platform must be commenced within one (1) year after the claim or cause of action arises. Failure to commence an action within this period shall permanently bar such claim.

BCC makes no representation that materials on the Platform are appropriate or available for use in all locations. Access to the Platform from regions where its contents are illegal is prohibited. By accessing the Platform, you agree to take responsibility for compliance with all local laws applicable in your jurisdiction.

19. Severability & Entire Agreement

If any provision of these Terms is determined to be illegal, invalid, or unenforceable by reason of the law of any state or country in which these Terms are intended to be effective, then — to the extent and within the jurisdiction in which that provision is illegal, invalid, or unenforceable — it shall be severed and deleted, and the remaining provisions shall survive and continue to be binding and enforceable.

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and BCC with respect to your use of the Platform, and supersede all prior or contemporaneous communications, proposals, and agreements — whether oral or written — between you and BCC regarding the Platform.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
